RELEASE OF LIABILITY – RECREATION FACILITIES WAIVER FORM - READ CAREFULLY – THIS AFFECTS YOUR LEGAL RIGHTS

In exchange for use of the property/facilities of Nellie Gail Ranch Owners Association at 25211 Empty Saddle Drive, Laguna Hills, CA, 92653, including, but not limited to, participating in tennis/pickleball play, tournaments, lessons, training, league play & general tennis/pickleball activity (hereinafter “Services”), I agree to the following:

1. I/ Member Participant agree to observe and obey all posted rules and warnings in regards to the Nellie Gail Ranch Tennis Center, and further agree to follow any oral instructions or directions given by Nellie Gail Ranch Owners Association, or the employees, representatives or agents of Nellie Gail Ranch Owners Association.

2. I/ Member Participant recognize that there are certain inherent risks associated with the above described activity and I assume full responsibility for personal injury to myself and further release and discharge Nellie Gail Ranch Owners Association for injury, loss or damage arising out of my use of or presence upon the facilities of Nellie Gail Ranch Owners Association, whether caused by the fault of myself, Nellie Gail Ranch Owners Association or third parties. Such waiver is not intended to waive gross negligence by Nellie Gail Ranch Owners Association.

3. I/ Member Participant agree to indemnify and defend Nellie Gail Ranch Owners Association against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my use of or presence upon the facilities of Nellie Gail Ranch Owners Association and/or in connection with the Services.

4. I/ Member Participant agree to pay for all damages to the facilities of Nellie Gail Ranch Owners Association caused by my negligent, reckless or willful actions.

5. Any legal or equitable claim that may arise from participation in the above shall be resolved under California law.
